Humble Appeal for Justice, Human Dignity, and the Rule of Law Regarding Retired Major General
Suresh Sallay
I write to Your Lordships with profound respect and humility as the wife of Retired Major General Suresh Sallay. I seek your pastoral intervention at a time when my husband is enduring immense physical, psychological, and emotional suffering while our family watches helplessly as his reputation, dignity, and honour are being publicly destroyed before any court of law has determined his guilt or innocence.
My husband, Retired Major General Suresh Sallay, is one of Sri Lanka's most highly decorated senior military officers. During more than thirty-five years of distinguished military service, he received numerous gallantry, campaign, and long-service decorations in recognition of his dedication, leadership, and service to the nation. Throughout his career, and particularly in his senior appointments, he faithfully served under five successive Presidents of Sri Lanka, irrespective of political affiliation, demonstrating unwavering loyalty not to any political party or individual, but to the State and its people. He devoted his life solely to the security and protection of Sri Lanka. Never during his career was he found guilty of misconduct or convicted of any criminal offence. His professional life was built upon discipline, integrity, honour, and selfless service, making the present circumstances all the more painful for our family.
Today, however, he remains detained under the Prevention of Terrorism Act merely as a suspect in an ongoing investigation. He has not been convicted of any offence, nor has any court of law found him guilty. The judicial process remains ongoing.
Yet despite this fundamental reality, he has already been condemned in the minds of many.
The principle that every individual is presumed innocent until proven guilty is not merely a legal doctrine. It is also deeply rooted in Christian teaching, which calls upon us to uphold justice, mercy, fairness, and the inherent dignity of every human being.
Sadly, this principle appears to have been forgotten.
My husband is being punished publicly long before any judicial determination has been made. His reputation has been systematically destroyed through relentless public accusations, media campaigns, and repeated assertions of guilt despite the complete absence of any judicial verdict.
Your Lordships, throughout the numerous investigations conducted into the Easter Sunday terrorist attacks over several years, including investigations by the Presidential Commission of Inquiry and investigations conducted with the assistance of the United States Federal Bureau of Investigation (FBI) and the Australian Federal Police (AFP), my husband was never identified as a suspect.
Despite these investigations, and despite the absence of any judicial finding against him, he is now publicly portrayed as the principal architect, the alleged "mastermind", behind one of the darkest tragedies in our nation's history.
This has caused immeasurable suffering to our family.
It is with great sadness that I also bring to Your Lordships' attention our deep concern regarding the continuing public narrative surrounding my husband, which has been actively promoted by Rev. Fr. Jude Rohan Silva and Rev. Fr. Cyril Gamini Fernando. For a considerable period, these repeated public statements have advanced the allegation that my husband was the "mastermind" behind the Easter Sunday attacks despite the fact that judicial proceedings remain ongoing and no court has found him guilty of any offence.
It is pertinent to note that the present investigation was initiated following a complaint made by Rev. Fr. Jude Rohan Silva of the Catholic Church and, subsequently, based on letter which contained allegations by Mr. Azad Maulana, which were submitted by Rev. Fr. Busebaduge Cyril Gamini Fernando.
In these circumstances, I am deeply concerned that certain members including the said two members of the clergy who have provided statements and are witnesses in this matter have continued to conduct regular press briefings and make public pronouncements regarding the case. These statements, made on an almost biweekly basis, appear to advance a narrative that my husband is the alleged mastermind behind the Easter Sunday attacks, notwithstanding the fact that the matter remains under investigation and has not been adjudicated by a court of law.
With the utmost respect to the clergy concerned and to the Church they represent, I submit that such conduct is inconsistent with the principles of fairness, impartiality, and justice that should guide all persons, particularly those who hold positions of spiritual and moral leadership. It is especially concerning when such public commentary emanates from individuals who are themselves witnesses in the proceedings and are therefore closely connected to the matter under investigation.
Furthermore, Article 13 of the Constitution of Sri Lanka enshrines the fundamental principle that every person is presumed innocent until proven guilty according to law.
Public statements that appear to prejudge the outcome of an ongoing investigation risk undermining this constitutional safeguard, influencing public opinion, and causing irreparable prejudice to the reputation and rights of the individual concerned.
In our respectful view, these repeated public statements have significantly influenced public opinion and contributed to sustaining a narrative that presents my husband as guilty before the courts have had the opportunity to determine the truth.
Given the moral authority enjoyed by priests of the Catholic Church, such statements inevitably influence the thoughts and emotions of thousands of faithful Catholics. The continuing repetition of these allegations has fuelled conspiracy theories, intensified public hostility towards my husband, and created an atmosphere in which he has effectively been judged in the court of public opinion before any judicial determination has been made.
Your Lordships, I respectfully submit that no individual, regardless of the seriousness of the allegations against him, should ever be publicly condemned before an independent court has spoken.
Another matter causing profound concern is the apparent conflict of interest surrounding the present investigation.
Individuals against whom serious allegations have previously been made, including allegations concerning negligence, dereliction of duty, failure to prevent the Easter Sunday terrorist attacks, failures in the handling of intelligence, and shortcomings in the subsequent investigations, are now exercising authority over the very investigation in which my husband is detained.
It is deeply troubling that officials whose own conduct in relation to the Easter Sunday tragedy has itself been questioned are now directing, supervising, or influencing an investigation arising from those very same events.
This creates a serious and reasonable perception of a conflict of interest.
Justice requires not only that investigations be fair and impartial, but that they must also be manifestly seen to be fair and impartial. Public confidence in the administration of justice is inevitably undermined when those whose own actions and omissions have been questioned in relation to the same tragic events are entrusted with investigating another individual connected with those events.
It deeply concerns us that while these serious questions regarding institutional accountability remain unresolved, public attention has instead been directed almost exclusively towards portraying my husband as the alleged "mastermind." This risks diverting attention away from legitimate questions of accountability while placing the entire burden of public blame upon one individual before any court has examined the evidence.
Even more distressing is the treatment my husband has allegedly endured while in State custody.
He has reportedly been subjected to torture and other cruel, inhuman, and degrading treatment. Judicial Medical Officers and Consultant Psychiatrists have reportedly identified significant psychological trauma consistent with torture and ill-treatment. His health deteriorated so severely that he commenced a prolonged hunger strike and was subsequently admitted to the National Hospital of Sri Lanka, where he continues to receive medical treatment.
Your Lordships, it has been heartbreaking to witness that instead of these allegations of torture being met with compassion and concern, sections of the media have sought to justify, excuse, and even celebrate his suffering.
Some have publicly suggested that because he is alleged to be connected to the Easter Sunday attacks, whatever treatment he receives is deserved.
This is deeply disturbing.
Torture can never become justice.
Cruelty can never become justice.
No allegation, however grave, can ever justify the denial of a person's God-given dignity.
If torture can be justified today because a person has been portrayed as guilty before trial, tomorrow no citizen in Sri Lanka will be safe.
Our concern extends far beyond my husband's personal suffering.
We fear that the continued public portrayal of him as guilty before trial has created an atmosphere in which justice itself is endangered. Courts should determine guilt based solely upon admissible evidence and the rule of law-not public opinion, political narratives, or sustained media campaigns.
If, after a fair and impartial trial, the courts determine that my husband is guilty, we shall respectfully accept that judgment.
However, if the courts determine that he is innocent, no judgment will ever restore the years of humiliation, the destruction of his reputation, the emotional suffering inflicted upon his wife, children, elderly mother, and family, or the life that has already been taken from him through relentless public condemnation.
Justice delayed is painful.
Justice prejudged is devastating.
Your Lordships, our family has deep Catholic roots.
My husband's beloved mother is a devout Catholic who has faithfully lived according to the teachings of the Church throughout her life. She raised her children with Christian values of honesty, compassion, humility, forgiveness, and love for one's neighbour. Above all, she taught them to respect
every religion equally and to treat every human being, regardless of faith, ethnicity, or background, with dignity, kindness, and compassion.
The Catholic faith has long been part of our extended family. One of my husband's close maternal relatives, the late Rev. Sister Martha Costa of the Holy Cross Convent, Jaffna, dedicated her life to God and to the service of the Church. Her life of faith, sacrifice, and devotion reflected the Christian values that have guided our family for generations. These values shaped my husband's character and have remained with him throughout his life and distinguished military service.
We therefore turn to the Church not in anger, but in hope.
The Catholic Church has always stood as the voice of conscience, the defender of justice, and the protector of human dignity.
We respectfully appeal to Your Lordships, as the shepherds of the Catholic Church in Sri Lanka, to reflect upon whether continued public assertions identifying my husband as the alleged "mastermind" before the conclusion of judicial proceedings are consistent with the Church's enduring commitment to justice, truth, charity, mercy, and the presumption of innocence.
We humbly ask that those who possess moral authority refrain from making public pronouncements that may prejudice pending judicial proceedings or contribute to the public condemnation of individuals who have not been convicted by a court of law.
We further appeal to Your Lordships to encourage that all public discourse surrounding this matter reflects the Church's unwavering commitment to justice, compassion, truth, and due process, allowing the independent courts of Sri Lanka to determine the truth solely upon the evidence placed before them.
We also respectfully ask Your Lordships to pray for my husband, for those who tragically lost their loved ones in the Easter Sunday attacks, for all those entrusted with administering justice, and for our nation, so that truth may prevail over speculation, justice over prejudice, compassion over hatred, and reconciliation over division.
May God grant Sri Lanka the wisdom to pursue justice with integrity, courage, humility, and mercy.
